Terms & Conditions
Effective date: August 1, 2026
These Terms of Service (the “Terms”) govern your access to and use of FastestApplicant, including the FastestApplicant website, account area, job-watcher tools, notifications, billing features, and related services (collectively, the “Service”).
The Service is provided by Rock Hard Consulting LLC, a New Mexico limited liability company doing business as FastestApplicant (“FastestApplicant,” “Company,” “we,” “us,” or “our”).
By creating an account, checking a box accepting these Terms, purchasing a paid plan or credit package, or otherwise accessing or using the Service, you agree to these Terms, our Privacy Policy, and our Refund and Cancellation Policy. If you do not agree, do not use the Service.
1. Eligibility and authority
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service.
If you use the Service for or on behalf of a business or other organization, you represent that you have authority to bind that organization. In that case, “you” includes both you and the organization.
The Service is primarily intended to help individual users monitor employment opportunities. A business may use the Service for lawful internal purposes, including monitoring publicly available job-market activity, but may not use the Service in violation of these Terms or applicable law.
2. What FastestApplicant does
FastestApplicant is applicant-side job-opportunity monitoring and notification software. Depending on the features available to your account, the Service may allow you to:
- create job watchers using keywords, countries, locations, remote-work preferences, and other criteria;
- receive notifications about jobs that match or may relate to your criteria;
- review jobs previously processed for your watchers, including jobs that were delivered or excluded;
- view matching terms, filtering explanations, or other processing results;
- use automated features such as JobHeat scoring or special-instruction detection; and
- use additional job-search productivity features that we may introduce.
FastestApplicant does not accept paid job postings from employers, sell job-listing promotion, operate an employer-candidate marketplace, automatically submit job applications, make hiring decisions, or decide whether any employer should interview, reject, or hire a person.
Features may differ by plan, location, account status, and release stage. Some features may be labeled beta, preview, experimental, or otherwise subject to additional limitations.
3. Accounts and authentication
You must provide accurate information and keep it current. You are responsible for activity occurring through your account and for protecting your login credentials, devices, email account, and connected notification accounts.
Authentication and account-management functions are provided through Clerk. Your use of Clerk-supported login functionality may also be subject to Clerk’s applicable terms and privacy practices.
You may not create accounts using false information, impersonate another person, share an account in a way that defeats plan limits, or create multiple accounts to evade restrictions, obtain duplicate free allowances, or avoid charges.
Notify us promptly at support@fastestapplicant.com if you believe your account has been compromised.
4. Job watchers, criteria, and results
You are responsible for the watcher criteria and instructions you provide. Broad, incomplete, contradictory, or unusual criteria may produce unexpected, incomplete, or irrelevant results.
The Service may process, exclude, prioritize, or deliver jobs based on your criteria, available third-party data, plan limits, credit availability, technical constraints, and automated analysis. A job that is not delivered to you may still be suitable, and a job that is delivered to you may not be suitable.
FastestApplicant does not promise that every matching job will be discovered, processed, delivered, or delivered before another person learns of it.
5. Third-party job information
Job and company information may be obtained from third-party providers, public sources, employer websites, or other listing sources. FastestApplicant does not control those sources and does not guarantee that any listing or related information is complete, current, unique, lawful, available, or accurate.
Listings may be duplicated, delayed, modified, expired, removed, incorrectly categorized, or missing important requirements. Salary, location, remote-work status, technologies, dates, application instructions, and other details may be incorrect or may change without notice.
You must verify important information with the original employer or listing source before relying on it or applying. Displaying a listing does not mean that FastestApplicant endorses the employer, recruiter, listing, role, compensation, working conditions, or application process.
FastestApplicant is not responsible for third-party websites, application systems, communications, interviews, offers, hiring decisions, employment relationships, or losses arising from them.
6. Automated analysis and AI-assisted features
The Service may use rules, statistical methods, machine learning, or artificial intelligence to analyze job information and user-supplied criteria. These features may include JobHeat scores, matching explanations, exclusion rationales, special-instruction detection, or generated application materials.
Automated outputs are estimates and may be incomplete, inaccurate, biased, misleading, or unsuitable for your circumstances. A JobHeat score is not an objective measure of a job’s quality and is not a prediction that you will receive an interview or offer.
You must independently review automated outputs and the original job listing. You are responsible for deciding whether to apply and for reviewing, correcting, and approving any generated content before using it.
FastestApplicant’s automated features are designed for the user’s own job-search organization. They do not make employment decisions and are not intended to be used by employers to make legally significant decisions about applicants or employees.
7. Notifications and messaging
You may choose to receive requested Service notifications through available channels, such as email or Telegram and, when offered, SMS or WhatsApp.
Notification frequency varies based on your watchers, settings, available jobs, plan, credits, and system activity. Delivery may be delayed, filtered, blocked, duplicated, or prevented by third-party networks or providers. We do not guarantee delivery or timing.
You may disable a watcher or notification channel in your account settings. You may also use the opt-out method shown in the applicable channel, including an email unsubscribe link or a command such as STOP or /STOP where supported.
Where SMS or WhatsApp notifications are offered, by providing a telephone number and enabling that channel, you request and consent to recurring automated Service messages relating to your configured watchers and account. Consent to SMS or WhatsApp messages is not a condition of purchasing the Service. Message and data rates may apply. You are responsible for ensuring that you control the number or account you provide and for updating it if ownership changes.
Opting out of job notifications does not prevent us from sending limited administrative, security, billing, legal, or account-service communications where permitted by law.
We currently use notifications for requested Service functionality, not third-party advertising or unrelated promotional campaigns.
8. Purchases through Paddle
Paid FastestApplicant products are sold through Paddle. Paddle acts as the merchant of record and authorized reseller for applicable transactions. Paddle handles checkout, payment processing, taxes, receipts, billing support, payment-method information, and certain refund and cancellation functions.
When you complete a Paddle transaction, you are also agreeing to Paddle’s applicable Buyer Terms, Refund Policy, and Privacy Notice. Those Paddle terms govern your transaction with Paddle. These Terms govern your access to and use of FastestApplicant.
Prices, billing intervals, included features, credit amounts, taxes, and other purchase details are shown on the pricing page or during checkout. In the event of a clear conflict concerning the payment transaction itself, Paddle’s applicable buyer terms and mandatory law control.
9. Free and paid plans
FastestApplicant currently offers an ongoing free plan called the Intern plan that is not a time-limited trial. The free plan allows prospective users to evaluate the Service before purchasing a paid plan.
Free-plan features, limits, credits, availability, and eligibility may change or be discontinued. We may impose reasonable limits to prevent abuse and preserve Service capacity.
Paid subscriptions are currently billed monthly unless a different interval is displayed at checkout. By starting a paid subscription, you authorize Paddle to charge the displayed subscription price and applicable taxes at the beginning of each billing period until cancellation.
If a payment fails, expires, is reversed, or cannot be collected, access to paid features may be limited, suspended, or returned to a free plan.
10. Subscription cancellation and plan changes
You may cancel a subscription through the FastestApplicant billing page. Paddle may also provide cancellation options through its buyer portal, transaction emails, or buyer-support process.
Unless the checkout or applicable law states otherwise, cancellation takes effect at the end of the current paid billing period. You may continue using paid features through that date, subject to these Terms. You will not be charged for a later renewal after cancellation takes effect.
Cancellation or a downgrade is separate from a refund request. You may submit a refund request within 14 calendar days of the relevant transaction, as described in the Refund and Cancellation Policy.
Canceling a paid subscription does not delete your FastestApplicant account. Deleting a FastestApplicant account immediately cancels any active Paddle subscription so that no subsequent renewal charges occur. Account deletion does not add restrictions to the refund request rights described in the Refund and Cancellation Policy.
11. Service credits
The Service may use credits to measure access to particular features or processing activity. Credits may be included with a plan, granted for another stated reason, or purchased separately.
Credits:
- may be used only within the FastestApplicant Service;
- are not legal tender, electronic money, a bank deposit, a gift card, or stored monetary value;
- have no cash value and cannot be redeemed for cash;
- are not transferable, assignable, or resellable between accounts;
- do not accrue interest;
- do not currently expire while your account remains open; and
- may be subject to feature-specific consumption rules shown in the Service.
Unused included and separately purchased credits remain in your account after subscription cancellation while the account remains open. They may be used subject to the then-current Service rules and availability.
Deleting an account removes access to unused credits associated with that account. This does not add restrictions to the 14-calendar-day refund request window described in the Refund and Cancellation Policy.
If Paddle refunds or reverses a purchase, we may remove the corresponding credits, plan access, or other benefits. We may also correct credit balances affected by error, duplicate grants, fraud, abuse, chargebacks, or unauthorized activity.
12. Automatic credit top-ups
If available, automatic top-up allows you to choose a credit threshold, a credit-package size, and a maximum top-up amount or limit for a monthly period. When your balance reaches the selected threshold, the Service may initiate a separate Paddle charge for the selected package, subject to the configured limit.
By enabling automatic top-up, you authorize those recurring threshold-triggered charges. You are responsible for reviewing the settings before enabling the feature.
You may disable or change automatic top-up through the billing settings. A change applies to future top-ups. Each completed automatic top-up is a separate transaction for which a refund request may be submitted within 14 calendar days under the Refund and Cancellation Policy.
13. Refunds
You may submit a refund request within 14 calendar days of any FastestApplicant transaction processed through Paddle, including an initial subscription payment, subscription renewal, one-time credit-package purchase, or automatic credit top-up.
Refund requests are processed by Paddle in accordance with Paddle's Refund Policy. FastestApplicant does not impose additional qualifiers, exclusions, or product-specific eligibility conditions.
Our Refund and Cancellation Policy is incorporated into these Terms. Nothing in these Terms limits any non-waivable consumer right.
14. User content
“User Content” means information or materials you submit to the Service, including watcher names and criteria, instructions, support messages, and, if related features are introduced, resumes, employment history, cover letters, or other application materials.
As between you and FastestApplicant, you retain ownership of your User Content. You grant FastestApplicant and its service providers a worldwide, non-exclusive, royalty-free license to host, copy, transmit, format, analyze, modify as technically necessary, and otherwise process User Content solely to operate, secure, support, maintain, and improve the Service, comply with law, and enforce these Terms.
You represent that you have the rights and permissions necessary to provide User Content and allow this processing. Do not submit content that is unlawful, infringes another person’s rights, contains malware, or includes personal information you are not authorized to provide.
15. Acceptable use
You may not use the Service to:
- violate any law, regulation, court order, contract, or third-party right;
- harass, threaten, deceive, impersonate, discriminate against, or harm another person;
- make or support unlawful employment decisions or automated decisions that produce legal or similarly significant effects about another person;
- scrape, crawl, copy, mirror, republish, resell, sublicense, or commercially exploit the Service or its data except with our written permission;
- bypass plan limits, credit accounting, rate limits, access controls, security measures, or payment requirements;
- create excessive traffic, interfere with Service operation, probe vulnerabilities, introduce malicious code, or attempt unauthorized access;
- use bots or automation not expressly supported by us;
- send spam, unsolicited marketing, or messages to destinations you do not control or have permission to use;
- reverse engineer or attempt to extract source code except where applicable law expressly permits it;
- use the Service to build a competing dataset, job-notification product, or substantially similar service; or
- assist another person in doing any of the above.
We may investigate suspected abuse and may preserve or disclose information when reasonably necessary to protect users, the Service, third parties, or legal rights.
16. FastestApplicant intellectual property
The Service, software, site design, text, graphics, workflows, databases, branding, and other materials provided by FastestApplicant are owned by or licensed to the Company and are protected by intellectual-property laws.
FastestApplicant, JobHeat, related logos, and related product names are trademarks or service marks of the Company or its licensors. No license to use those marks is granted except as necessary to identify the Service truthfully.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.
17. Third-party services
The Service relies on third parties, which may include Clerk, Cloudflare, Paddle, TheirStack, Resend, Proton, Telegram, Mapbox, and other providers introduced from time to time. Third-party services are governed by their own terms and privacy practices.
We are not responsible for a third party’s availability, acts, omissions, security, policies, or changes. A third-party outage or restriction may delay or prevent part of the Service.
18. Suspension, termination, and account deletion
You may stop using the Service at any time and may use available account controls to request account deletion.
We may limit, suspend, or terminate access if we reasonably believe that you violated these Terms, failed to pay amounts due, created risk or legal exposure, abused the Service, or if suspension is required by a provider or law. Where reasonable, we will attempt to provide notice and an opportunity to correct the issue.
Account deletion removes most active account information from our primary application systems, but it does not necessarily erase every record immediately. Billing, transaction, plan, credit-ledger, fraud-prevention, security, support, operational, backup, and legally required records may be retained. Paddle and other independent providers may also retain records under their own obligations. See the Privacy Policy for details.
Sections that by their nature should survive termination will survive, including payment obligations, ownership, disclaimers, liability limits, dispute provisions, and restrictions on misuse.
19. Changes, availability, and discontinuation
We may update, add, remove, limit, or discontinue features, integrations, plans, credit rules, or the Service. We may perform maintenance and may experience outages or delays.
We will use reasonable efforts not to materially reduce a paid user’s core purchased access during an already-paid billing period without notice. If we permanently discontinue paid access before the end of that period, any remedy will be handled as required by applicable law and Paddle’s policies.
We may offer preview or beta features that are more likely to contain errors, change substantially, or be discontinued.
20. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” FastestApplicant disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment.
We do not warrant that the Service will be uninterrupted, secure, error-free, complete, or compatible with every device or provider. We do not guarantee any number, quality, timing, or suitability of job opportunities, notifications, applications, interviews, offers, salary, employment, or career outcome.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
21. Limitation of liability
To the fullest extent permitted by law, FastestApplicant and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or employment opportunity, arising from or related to the Service.
To the fullest extent permitted by law, our total aggregate liability arising from or related to the Service or these Terms will not exceed the greater of:
- the amount you paid for FastestApplicant access during the 12 months immediately before the event giving rise to the claim; or
- US $100.
These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose.
Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot be limited under applicable law. Mandatory consumer rights remain unaffected.
22. Governing law and disputes
Except to the extent mandatory law provides otherwise, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Subject to any mandatory right of a consumer to bring a claim elsewhere, the state courts located in Palm Beach County, Florida, and the federal courts serving Palm Beach County, Florida, will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service. You and FastestApplicant consent to those courts’ jurisdiction and venue.
Before filing a claim, you agree to send a written description of the dispute to legal@fastestapplicant.com and allow 30 days for an informal attempt to resolve it. This does not prevent either party from seeking urgent injunctive relief or using a small-claims procedure where available.
These Terms do not require arbitration and do not contain a class-action waiver.
23. Electronic communications
You agree that we may provide agreements, disclosures, notices, receipts, and other communications electronically, including by email, in-product notice, or publication on the Service. You are responsible for keeping your account email address current.
24. Changes to these Terms
We may update these Terms from time to time. The updated version will show a new effective date. If a change is material, we will provide reasonable notice through the Service or by email where required.
Your continued use after the updated Terms take effect constitutes acceptance, except where applicable law requires express consent. If you do not agree to an update, you must stop using the Service and cancel any subscription before the update takes effect.
25. General terms
These Terms, together with the policies incorporated by reference and any purchase-specific terms displayed at checkout, are the entire agreement between you and FastestApplicant concerning the Service.
If a provision is unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, asset transfer, or change in control.
Headings are for convenience only. The words “including” and “includes” mean “including without limitation.”
